The attorneys in our litigation group represent clients involved in a broad range of litigation matters in state and federal courts, at both the trial and appellate court level. Our major litigation practice areas include:

* Business Litigation. The representation of parties in complex and simple commercial and business litigation matters;

* Labor and Employment Litigation. The representation of employers in lawsuits alleging wrongful termination, discrimination, breach of contract, breach of privacy and other tort claims;

* Banking and Creditor Litigation. The representation of banks and other creditors in an array of matters including secured creditor litigation, mixed collateral judicial foreclosure actions, receivership proceedings, and lender liability actions;

* Real Property Litigation. The representation of property owners in connection with disputes involving adverse claims to real property, land use rights, water rights and environmental issues in matters pending before the civil courts, as well as matters pending before governmental and administrative agencies;

* Fiduciary Litigation. The representation of parties to partnership and shareholder disputes; and

* Franchise Litigation. The representation of franchises in disputes with governmental franchising authorities, the representation of private franchisers in disputes with franchisees, and the representation of private franchisees in disputes with franchisers.

In addition, our litigation attorneys have substantial experience litigating disputes involving intellectual property rights, insurance coverage disputes, and disputes involving trusts and estates.

Labor and Employment

Sinsheimer Juhnke McIvor & Stroh represents employers in all aspects of labor and employment, including comprehensive counseling of employers on Americans with Disabilities Act compliance, wage and hour issues, labor/management relations, preparation of personnel policies and forms, management training, representation in union elections, collective bargaining negotiations, grievances and arbitrations, preparation of employment agreements, pre-discharge counseling and representation of employers in state and federal courts, and before the National Labor Relations Board, the Equal Employment Opportunity Commission, the U.S. Department of Labor, the California Department of Fair Employment and Housing, and the California Labor Commissioner.
